Terms of Service

src/lib/legal.ts, and have a lawyer read this before taking real payments.1. Who we are
OFFPEAK is operated by [YOUR LEGAL NAME OR COMPANY], ABN [ABN]. Contact us at [YOUR EMAIL].
We are a booking service, not a gym. When you book through OFFPEAK you are buying a single visit to a gym operated by someone else, and your visit is also subject to that gym's own rules and conditions of entry.
2. Booking
- You must be 18 or over.
- Your booking is for one person, at one gym, at one time. It is not transferable — the name on the booking must be the person who attends.
- A booking is confirmed only once payment has cleared.
3. Getting in
- Bring photo identification showing the name on your booking. Any government photo ID is fine, including a foreign passport or overseas licence. It does not need to be Australian.
- Where the gym has provided its conditions of entry, you sign them when you book. Some gyms will ask you to complete additional paperwork or an induction on arrival.
- The gym may refuse entry if your ID does not match your booking, if you will not complete their requirements, or if you are intoxicated or behaving unsafely. We cannot refund you if entry is refused for one of these reasons.
4. Price
- Each gym sets its own price for the hours it lists.
- The price rises the more you use us in one place. After five sessions at one gym the price increases, and again after ten. Separately, after five sessions anywhere in one city, the price increases across every gym in that city. OFFPEAK is for training while you are away from home, not as a substitute for a membership.
- A booking fee is added to each booking and shown before you pay.
- All prices are in Australian dollars and include GST where it applies.
5. Where you live
OFFPEAK is for training away from home. You tell us your home city when you book, and you cannot book gyms in that city.
We check this. Your bank tells us the city registered to your payment card. If that city is the same as the gym you booked, we will cancel the booking and refund you in full, and record that city as your home city for future bookings. A refund may take a few business days to appear, depending on your bank.
The first home city you give us is the one we keep.
6. Cancelling and refunds
- Cancel before your session starts by emailing [YOUR EMAIL] and we will refund you in full.
- If you do not attend and did not cancel, we cannot refund you.
- If the gym is closed or cancels your session, we refund you in full.
- Refunds go back to the card you paid with.
Nothing here limits your rights under the Australian Consumer Law.
7. Your safety
- The gym is responsible for its premises, its equipment and everyone on site. We do not own, operate, inspect, staff or supervise any gym.
- Exercise carries risk. You are responsible for training within your ability and for telling the gym about any condition affecting your safety.
- To the extent the law allows, we are not liable for injury, loss or damage arising from your visit to a gym. This does not exclude any liability that cannot be excluded under Australian law, including under the Australian Consumer Law.
- We do not provide accident, medical or travel insurance. If you want cover, arrange your own.
8. Behaving yourself
Follow the gym's rules and treat their staff and members decently. We can cancel bookings and refuse future ones if you don't, and gyms can block you from their own quiet hours.
9. Your information
We collect your name, email, home city and payment details. See our privacy policy for what we do with them. We pass your name and email to the gym you book so they can admit you, and where you sign a gym's conditions of entry we pass them your signature and the time you gave it.
10. If something goes wrong
Email us at [YOUR EMAIL] first — most things are sorted in a message or two. These terms are governed by the laws of New South Wales.
11. Changes
We may update these terms. The version that applies to your booking is the one published when you booked.
